The right of withdrawal does not apply to the supply of food which, by its nature, cannot be returned or is liable to deteriorate or expire rapidly during transport.
The right of withdrawal is excluded in the following cases, pursuant to art. 59 of Legislative Decree 21/2014:
– order of products by a non-consumer customer and/or who requests an invoice
– order of products made to measure or clearly personalized;
– order for products that are likely to deteriorate or expire rapidly;
– order of sealed products that do not lend themselves to being returned for hygienic or health protection reasons or that have been opened after delivery.
With reference to the cases where withdrawal is excluded listed above, the customer is informed and accepts that all food products (including wines, spirits, and beverages) are considered "risks of deterioration or rapid expiration," as the characteristics and qualities of these types of products are subject to alteration, including as a result of improper storage. Therefore, for hygiene and customer protection reasons, they cannot be returned to the manufacturer and put back on the market without endangering consumer health.
